Please note that in line with Protocol 4 of the Southern African Development Community (SADC) Economic Partnership Agreement (EPA) between the region and European Union (EU), all tariff quotas and preferential measures from the Trade Development Co-operative Agreement with South Africa have been suspended as of 01.11.2016.
Therefore we can confirm that the tariff quota 09.1825 to which zero rate of duty is paid with a preference certificate EUR1 or Invoice Declaration is no longer applicable.
Nevertheless, the implementing regulation opening new tariff quotas in the SADC-EPA framework is being processed and adopted by the EU and should be applicable retroactively as soon as it is published in the Official Journal of the EU. The proposal for the implementing regulation is in its final stage but it still has to be adopted.
Once the regulation is published, the EU importers can claim the benefit of the tariff quota by correcting their initial customs declaration. Then, the customs authority of the EU member states will automatically send these requests (with the initial date if acceptance of the declaration) to the Commission for allocation.
Once the responses are received by the management information systems, the duties will be reimbursed.
